These Terms govern access to and use of Clinched, including the contractor dashboard, hosted proposal pages, homeowner portal, and related services. By creating an account or using the service, you agree to these Terms.
1. The service
Clinched is a technology provider, not a contractor, insurer, lender, or licensed broker. We do not perform, supervise, or guarantee any contractor's work. Any warranty, license, or insurance claim made within a proposal is the contractor's representation, not ours.
2. Accounts & acceptable use
You must provide accurate information and keep credentials secure. You agree not to use the service unlawfully, misrepresent your licensing/insurance, send unsolicited communications in violation of CAN-SPAM/TCPA, or attempt to breach the service's security.
3. Payments
Subscription fees are processed via Stripe. Homeowner deposits are processed via Stripe Connect directly to the contractor's account — Clinched is not a party to the underlying home-service contract and does not hold or adjudicate disputes over that transaction. Subscriptions are month-to-month with no lock-in; you may cancel and export your data anytime.
4. AI-generated content
Clinched's AI drafts proposal content from information you provide. You are responsible for reviewing and approving all content before sending it to a customer — we do not warrant the accuracy of AI-generated text or suggestions.
5. Disclaimers & limitation of liability
The service is provided "as is," without warranties of any kind to the extent permitted by law. Clinched's total liability for any claim will not exceed the amount you paid in the 12 months before the claim arose, and we are not liable for indirect or consequential damages, or for disputes between a contractor and a homeowner arising from work performed outside the service.
6. Termination
Either party may terminate at any time. You may export your data for a reasonable period after termination.
